1. DEFINITIONS

1.1 In these general terms and conditions, the terms and expressions used below are defined as follows:

  • General Terms and Conditions: these general terms and conditions
  • Visitor: the natural or legal person who, on the basis of an agreement, purchases or wishes to purchase a Virtual Reality experience from VRcafe for a certain period.
  • Participation Agreement: the agreement between the Visitor and the Organisation under which the Visitor is entitled to participate in the Virtual Reality experience.
  • VRcafe: a trade name of VRcafe, legally established in Haarlem, registered with the Trade Register of the Chamber of Commerce under number 58448578.
  • Equipment: all devices made available for use by VRcafe, as well as all accessories, cabling and packaging materials belonging to the aforementioned items.

2. APPLICABILITY

2.1 These General Terms and Conditions apply to all offers, quotations and agreements of VRcafe, as well as to all obligations arising from them.

2.2 If any provision of the General Terms and Conditions is void or annulled, the remaining provisions shall remain fully in force. In that case, the parties shall consult with each other in order to agree on new provisions to replace the void or annulled provisions, taking into account as much as possible the purpose and intent of the non-annulled provisions of the General Terms and Conditions.

3. RESERVATION

3.1 All reservations for VRcafe are made through the booking system on www.vrcafehaarlem.nl. Telephone reservations are also entered through this booking system. External assignments are handled separately with project managers of VRcafe by means of quotations and/or invoicing. The reservation is confirmed by email. If this confirmation email has not been received, the reservation has not been recorded. Please note that the confirmation email may occasionally end up in the spam folder.

3.2 Make sure you arrive on time! If you are late, the duration of the VR experience unfortunately has to be shortened. The reserved time is the start time of the programme.

4. CANCELLATION & CHANGES

4.2 Refund in case of cancellation without cancellation insurance
In case of cancellation without valid cancellation insurance, the following refund policy applies:

5. PAYMENT

5.1 The Visitor is deemed to be aware of and to agree with the rates applied by VRcafe. The Visitor must pay the total amount by bank transfer no later than 48 hours before the start of the reservation, unless otherwise agreed in writing.

5.2 Consumptions and purchases at VRcafe can be paid by debit card. For safety reasons, cash is not accepted.

5.3 Deal codes or discount codes are only valid during the promotional periods indicated by VRcafe. Booking with a promotional code is only allowed when both the booking and the visit take place within the valid promotional period. It is not permitted to use a promotional code for reservations outside this period.

5.4 Promotional codes or discount codes are not valid in combination with other promotions, discounts, offers or other promotional codes, unless expressly stated otherwise by VRcafe.

5.5 Promotional codes or discount codes cannot be exchanged for cash and cannot be refunded. If the value of the promotional code or discount code is higher than the total amount of the reservation, the remaining amount will not be paid out or saved for future use.

5.7 It is not possible to use promotional codes or discount codes on Gift Cards.

6. MINIMUM AGE & SUPERVISION

6.1. The recommended minimum age is 7 years. Children up to 14 years old must be accompanied by at least one adult.

7. ACCESSIBILITY

7.1. The VR experience is suitable for wheelchair users. Please contact us to discuss the possibilities.

8. LIABILITY

8.1. The customer declares that they are aware that the equipment is delivered to them by VRcafe in good condition.

8.2. If a malfunction occurs in or to the equipment during the VR experience, the customer must report this immediately to a VRcafe employee. The Visitor is not permitted to resolve malfunctions themselves and/or carry out repairs to the equipment, unless this has been expressly agreed in writing between the parties. If malfunctions or defects in, to or of the equipment are not reported immediately or not reported at all to VRcafe, the customer shall be fully liable for all damage resulting from this.

8.3. All damage caused to the Equipment during the period of use, regardless of the cause or circumstances, shall be at the expense of the Visitor, provided that compensation for such damage is not covered by any insurance taken out by the Visitor.

8.4. VRcafe is never liable for direct or indirect damage arising during the VR experience as a result of the Equipment not functioning, not functioning properly or not functioning as expected, or for damage caused to persons and/or property by or during the use of the Equipment.

8.5. VRcafe is not liable in the event of loss, theft or damage to money, jewels, jewellery, works of art, valuable documents or other valuables.

8.6. The liability of VRcafe is at all times limited to the amount for which VRcafe is insured, increased by the amount of the deductible applicable under that insurance. VRcafe is in any case not liable for:

  • Damage resulting from the Visitor’s failure to follow instructions given by or on behalf of the Organisation and from failure to comply with general standards of public order, morality and decency;
  • Damage resulting from loss, damage or theft of goods belonging to the Visitor and brought to the Premises;
  • Damage caused by other Visitors.

8.7. The Visitor who is culpably in breach of their obligation(s), including but not limited to acting in violation of these General Terms and Conditions, is liable towards VRcafe for the damage suffered or to be suffered by VRcafe, both direct and indirect, without prejudice to its other rights.

8.8. The Visitor indemnifies VRcafe against all claims from third parties in connection with their acts or omissions.

8.9. VRcafe shall refrain from involvement in disputes to which it is not a party, including but not limited to disputes between Visitors themselves.

9. INSURANCE

9.1. The Visitor must ensure sufficient insurance coverage for the equipment to be used against loss, theft or damage caused to or by the equipment to be used, during the entire period of use. The insured value of the items to be used will be communicated by VRcafe upon written request from the Visitor.

10. MISCELLANEOUS

10.1. The customer shall not copy data from quotations or rental agreements and/or show or disclose them to third parties.

10.2. Drug and/or alcohol use is prohibited during and before the VR experience. If, at the start of the game, a VRcafe employee has doubts about the condition of a Visitor, the employee has the right to refuse this Visitor without refund of the registration fee. In the event of undesirable behaviour, VRcafe reserves the right to terminate the Visitor’s participation at any time.

10.3. The Participation Agreement, of which the General Terms and Conditions form part, is governed exclusively by Dutch law.

10.4. The General Terms and Conditions are available at https://www.vrcafehaarlem.nl and at the Chamber of Commerce. They will also be sent upon request. By registering, the Visitor declares that they agree to the General Terms and Conditions.
